What is an Order of Protection?

An order of protection is issued by the court after filing by the "victim" seeking relief against the alleged "abuser." Its purpose is designed to offer quick and significant legal protection with equally significant consequences against the "abusive" family or household member. Truthfully, the Order of Protection process itself can and has sometimes been "abused" by those seeking to "gain an upper hand/leverage" say in an impending divorce or family law matter. An Order of Protection can, amongst other things, impose the following relief:

  • prevent threats, harassment, intimidation and/or physical abuse
  • require the abuser to seek therapy
  • require the abusive parent to pay child support and relinquish custodial rights
