What is an Order of Protection?
An order of protection is issued by the court after filing by the "victim" seeking relief against the alleged "abuser." Its purpose is designed to offer quick and significant legal protection with equally significant consequences against the "abusive" family or household member. Truthfully, the Order of Protection process itself can and has sometimes been "abused" by those seeking to "gain an upper hand/leverage" say in an impending divorce or family law matter. An Order of Protection can, amongst other things, impose the following relief:
- prevent threats, harassment, intimidation and/or physical abuse
- require the abuser to seek therapy
- require the abusive parent to pay child support and relinquish custodial rights
- forbid the abuser from entering the shared place of residence
- prohibit the abuser to stay away from work, school, or certain locations and other people who are also protected under the orders of protection
- protect the victim from harm and danger by the abuser
If the facts of your situation so warrant, an Order of Protection should be promptly initiated. If you are on the "receiving end" of one and you believe the underlying facts and available evidence would require a defense hearing to challenge same, attorney Van A. Larson is available to help you
