Illinois Spousal Maintenance Guidelines

As recently as last year, spousal support was left entirely to the discretion of the court in Illinois, which often led to unpredictable results. Beginning in 2015, however, Illinois law now provides a standardized guideline for developing spousal maintenance orders. The circumstances of the marriage dictate whether support is appropriate, but when it is, courts are required to follow the formula set forth in the law.

Amount: Using both spouses’ gross income, the amount to be paid is equal to 30 percent of the payor’s income minus 20 percent of the payee’s income, as long as the award plus the payee’s income does not exceed 40 percent of the couple’s total income.

Duration: The length of time the award will be in force is to be calculated as a percentage of the length of the marriage. The duration will equal the length of the marriage times the appropriate percentage factor:

  • 20 percent for marriages lasting up to five years;
  • 40 percent for marriages lasting five to ten years;
  • 60 percent for marriages lasting ten to 15 years; and
  • 80 percent for marriages lasting 15 to 20 years;

Marriages lasting 20 or more years are subject to support awards equal to the length of the marriage or the court may choose to award permanent maintenance.

The courts are granted some freedom to deviate from the standard guidelines if necessary, based on the facts of an individual case.
